PAIA and POPIA Manual

Prepared in terms of Section 51 of the Promotion of Access to Information Act, 2 of 2000.

This manual assists people in exercising their constitutional right to access information held by Nostics Digital. It also outlines how we process personal information in accordance with POPIA.

5. Records Held by Nostics Digital

We maintain records on the following subjects, which may be requested subject to refusal grounds:

  • Corporate Records: Founding documents, tax records, and financial statements.
  • Client Records: Service level agreements and usage data for the Pulse system.
  • Personnel Records: Employment contracts and internal policies.

6. Processing of Personal Information (POPIA Requirement)

Nostics Digital processes data as follows:

  • Purpose of Processing: Provide SaaS services via Pulse, manage accounts, and comply with legal obligations.
  • Categories of Data Subjects: Clients, employees, and secondary data subjects (client employees processed via Pulse).
  • Recipients of Data: Third-party hosting providers and relevant regulatory bodies when required.
  • Security Measures: Encryption and access controls to ensure confidentiality and integrity.

7. How to Request Access

7.1 The Request Process

  1. Complete Form 2: Request for Access to Record at https://inforegulator.org.za/wp-content/uploads/2020/07/InfoRegSA-PAIA-Form02-Reg7.pdf.
  2. Provide sufficient detail to identify the record and requester.
  3. Specify the right you are exercising or protecting and explain why the record is required.
  4. Submit the completed form and proof of payment to tools@busnostics.com.

7.2 Fees

  • Request Fee: Standard non-refundable fee (currently R140.00 for private bodies).
  • Access Fee: Charged if the request is granted for the time required to search, prepare, or reproduce records.

7.3 Our Response

The Information Officer will respond within 30 days. This may be extended once for an additional 30 days if needed.
